Quick answer
An above-garage ADU is an accessory dwelling unit built as a second story on top of a garage, so the garage stays usable below and the home sits above it.
Most are detached, over a backyard garage. Some sit over an attached garage. Two things usually decide if one works: the height limit for your lot and whether the garage can carry a floor above it.

Key takeaways
- An above-garage ADU stacks a home on top of a garage.
- California has no separate “over-garage” rule. The unit follows detached or attached ADU rules 1.
- The state height floor for a detached ADU is 16 ft. That is often too low for two stories 1.
- Many cities allow more. The local height limit is the deciding number.
- The garage’s footings and walls must carry the new floor. An engineer checks this.
- The garage must be fire-separated from the home above 5.
What it means, in plain English
Picture a two-car garage with a small apartment on top. You park below. Someone lives above. Stairs on the side lead to the front door.
Older neighborhoods call these carriage houses. Builders often call them garage apartments. In ADU terms, it is usually a detached ADU with a garage under it.
It is not a conversion. A garage conversion turns the garage itself into the home. Here the garage stays a garage, and the home is new space added above.
Why it matters to you
Building up saves ground. On a small lot, the yard and the parking both survive. For many owners that is the whole point.
But up is harder than out. Stairs take floor space. The structure below must be strong enough. And the height limit may simply not allow a second story.
So the first question is not design. It is height. Find your limit before anything else.
Rules: the height California guarantees
For a unit over a detached garage, the first two rows matter most. The figures below are floors, not caps.
| Situation | Minimum height a city must allow | Subsection |
|---|---|---|
| Detached ADU on a lot with a single-family or multifamily home | 16 ft | § 66321(b)(4)(A) 1 |
| Detached ADU within ½ mile walking distance of a major transit stop or high-quality transit corridor | 18 ft, plus 2 ft more for a roof pitch that matches the main house | § 66321(b)(4)(B) 1 |
| Detached ADU on a lot with a multistory multifamily building | 18 ft | § 66321(b)(4)(C) 1 |
| ADU attached to the main house | 25 ft or the local limit for the house, whichever is lower; no city must allow more than two stories | § 66321(b)(4)(D) 1 |

What the height numbers mean for a second story
A garage needs headroom for cars. The unit above needs a 7-foot ceiling in living space under the model code 5. Add floor framing and a roof, and two stories usually need more than 16 feet.
So under the state floor alone, a detached above-garage unit may not fit. The question is your city’s own limit. Many local codes allow taller accessory buildings, sometimes in certain zones only. See our height limit guide for how codes measure it.
An attached garage is different. A unit over it is an attached ADU, and the state floor is 25 feet or the house’s local limit, whichever is lower 1. That is often enough for two stories.
Types of above-garage ADU
| Type | How it is built | Main question |
|---|---|---|
| Over an existing detached garage | A new floor added on the old garage | Can the slab, footings and walls carry it? |
| New garage and unit together | Both levels built from scratch | Local height limit and setbacks for new work 2 |
| Over an attached garage | A new floor over the house’s garage | Attached-ADU height and size caps 1 |
| Partial: unit beside and over the garage | Split level or L-shape | How the city measures height and floor area |
How an above-garage ADU project works
- Find your height limit. Ask the planning department for accessory buildings in your zone.
- Check the garage. An engineer reviews footings, slab and walls for the new load.
- Plan the stairs. Inside or outside, at least 36 in wide with 6 ft 8 in headroom under the model code 5.
- Plan fire separation. The garage must be separated from the dwelling as the code requires 5.
- Check setbacks. New construction can face up to 4 ft side and rear setbacks in California 2.
- Design the unit. Kitchen, bath and windows that meet escape rules in sleeping rooms 5.
- Apply and build. In California, an ADU permit is reviewed by fixed rules, with no public hearing.
Worked example: does a second story fit?
A hypothetical detached garage in California. The heights below are design inputs chosen for the arithmetic, not standard sizes. The 7 ft ceiling is the model-code minimum 5.
| Layer | Height (hypothetical) | Running total |
|---|---|---|
| Garage wall to ceiling | 8 ft | 8 ft |
| Floor framing between levels | 1 ft | 9 ft |
| Upper living space ceiling | 7 ft (minimum) | 16 ft |
| Roof framing and pitch to the peak | 4 ft | 20 ft |
Total: about 20 ft. That is above the 16 ft state floor for a detached ADU 1. It works only if the city allows more, or the lot qualifies for 18 ft plus 2 ft for a matching roof pitch near transit. The size envelope calculator helps test your own numbers.
What the garage below has to carry
Read the stack below from the roof down. Each layer passes its weight to the one beneath it, so a weak base limits everything above.
A garage slab is often built only for cars. Its edges may not have footings sized for a second floor. The walls may be framed lightly, with a wide door opening.
Adding a story puts weight on all of that. A structural engineer decides if the footings need to be bigger, if the door header must change and if new posts are needed.
Sometimes the answer is to tear down and rebuild. That costs more, but it gives you a sound base designed for both levels.
- Roof and ADU wallsNew framing; adds weight the garage never carried
- ADU floorNew floor framing that spans the garage below
- Fire separationThe garage ceiling and walls are fire-separated from the dwelling
- Garage walls and door headerOften light framing with a wide opening; may need a new header or posts
- Slab and footingsOften built for cars only; may need bigger footings for two stories
A general picture, not a design. A structural engineer sizes each part for your site.
Where you will see it
- On the site plan: the building footprint, its setbacks and the stair location.
- On the elevations: the height from grade to the top, checked against the local limit.
- In the structural sheets: footing sizes and the beam over the garage door.
- In plan-check comments: garage fire separation and stair rules 5.
- On the bid: a line for foundation work if the garage needs new footings.
Rules outside California
Garage apartments are allowed in many cities across the country. But height, size and parking rules vary widely. Some cities cap accessory buildings at one story. Others allow two with extra review.

Costs and what drives them
We do not publish a typical price. These are the drivers. For data, see California ADU cost research.
- Foundation upgrades under an existing garage.
- Stairs, inside or out, and the floor area they use.
- Fire separation between the garage and the home 5.
- Plumbing and drains run up to a second floor.
- Impact fees in California only above 750 sq ft of living space 3.
- Utility hookups: new construction may be required to connect separately in California 3.
Benefits and limits
What it does well
- Keeps the garage and its parking.
- Uses less yard than a new one-story ADU.
- Upper-floor views, light and privacy.
- Separates the tenant from the main house.
Where it falls short
- Often needs more height than the 16 ft state floor 1.
- The garage may need new footings.
- Stairs use space and can be hard for older people.
- A tall building near the line can face neighbor concerns about windows.
Above-garage ADU compared with related terms
| Term | Garage use after | Height need |
|---|---|---|
| Above-garage ADU | Still a garage | Two stories |
| Garage conversion | Gone; it becomes the home | One story; existing height |
| Two-story ADU | Usually no garage | Two stories |
| Attached ADU | Not part of it unless built over one | Up to 25 ft floor in CA 1 |
Common mistakes
- Myth California guarantees two stories for an ADU over a garage.
- Reality For a detached unit, the state floor is 16 ft, or 18 ft in some cases 1. Two stories depend on local limits.
- Myth Adding a floor over a garage counts as a conversion.
- Reality The new upper floor is new space. Ask how your city applies setback and fee rules to it.
- Myth Any garage can hold a second floor.
- Reality Many garage slabs were never designed for it. An engineer must check.
- Myth The garage and the unit can share open space.
- Reality The code requires fire separation between a garage and a dwelling 5.
What to ask the city and your engineer
- What is the height limit for a detached accessory building in my zone?
- Does my lot qualify for the 18 ft transit allowance?
- Does the garage area count toward the ADU size cap?
- Do the existing footings need to be enlarged?
- Where can the stairs go without crossing a setback?
- What fire rating does the garage ceiling need?
Checklist for your project
- Get the local height limit in writing.
- Sketch the stack: garage, floor, living space, roof.
- Hire an engineer to inspect the garage.
- Place the stairs and check setbacks.
- Confirm how floor area is counted.
- Apply with structural and fire-separation details.

Questions about above-garage adu
Can I build an ADU over my garage?
Often, yes, if your height limit allows a second story and the garage can carry it. In California, a unit over a detached garage follows detached ADU rules. The state floor for height is 16 feet, so many projects rely on a higher local limit.
How tall can an ADU over a garage be in California?
State law sets minimums. A city must allow at least 16 feet for a detached ADU, 18 feet near major transit plus 2 feet for a matching roof pitch, and 18 feet on a lot with a multistory multifamily building. An attached ADU gets 25 feet or the house’s local limit, whichever is lower.
Is an ADU over a garage attached or detached?
It depends on the garage. Over a detached backyard garage, the ADU is detached. Over a garage that is part of the house, the ADU is attached. The label matters because height and size rules differ for each type.
Is a garage apartment the same as an ADU?
A garage apartment is a common name for a home above a garage. If it has its own kitchen, bathroom and living space on a lot with a main home, it is an ADU under California’s definition 4. Older garage apartments may not have permits.
Does my garage need new footings to add an ADU on top?
Often. Garage slabs and footings are frequently built for one story and cars only. A structural engineer checks if they can carry the new floor, walls and roof. If not, you may need to enlarge footings or rebuild the garage.
Do I lose parking with an above-garage ADU?
No. The garage stays a garage, so its spaces remain. That is a main reason owners choose this form. In California, a city also cannot require new parking for many ADUs, but that rule is separate.
What stairs does an above-garage ADU need?
Under the 2024 International Residential Code, stairways must be at least 36 inches wide and have at least 6 feet 8 inches of headroom. Stairs can be inside or outside. Outside stairs save floor space but must stay out of required setbacks.
Does the garage need fire separation from the ADU?
Yes. The model code requires a garage to be separated from a dwelling by fire-resistant construction, set out in its Table R302.6. Your designer details the ceiling and any walls that touch. Your local building department confirms the rule it has adopted.
Is an ADU over a garage a conversion?
Not usually. A conversion turns existing space into a home. Here the home is new space added on top. California’s easier conversion rules apply to existing space, so ask your city how it treats the new upper floor for setbacks and fees.
Does an ADU over a garage pay impact fees?
In California, no impact fee may be charged for an ADU of 750 square feet of interior livable space or less. Above that, fees must be proportional to the size of the main home. Utility connection rules for new construction may differ from those for conversions.
